This section defines "Driving" and "Text messaging" to establish the scope of prohibited activities for contractors operating motor vehicles under FAR Subpart 26.6.
Key Rules
- Driving:
- Includes operating a vehicle on any active roadway while the motor is running.
- Includes periods when the vehicle is temporarily stationary due to traffic, stop signs, or traffic lights.
- Excludes situations where the operator has pulled over to the side of the road or off the roadway to a safe, stationary location.
- Text messaging:
- Encompasses reading from or entering data into any handheld or electronic device for SMS, email, instant messaging, or general data communication/retrieval.
- Includes manual entry of navigational information while driving.
- Excludes glancing at or listening to a GPS/navigation device, provided the device is secured in a commercially designed holder and was programmed before driving or while safely parked.
Practical Implications
- Contractors must ensure employees understand that being stopped at a red light does not exempt them from texting prohibitions, as they are still considered "driving" under FAR definitions.
- To remain compliant while using GPS, personnel must program routes prior to transit or pull completely off the active roadway to make adjustments.
