Overview
FAR Subpart 32.4 establishes the policies and procedures for providing advance payments to prime contractors and subcontractors for non-commercial acquisitions. As the "least preferred" method of contract financing, it is authorized sparingly and only when other financing options (like progress payments or private loans) are unavailable or impractical.
Key Rules
- Order of Preference: Advance payments are generally considered only if other types of financing are not reasonably available to the contractor in adequate amounts.
- Statutory Limitations: Advance payments cannot exceed the unpaid contract price and must be supported by adequate security.
- Authorization Criteria: To approve advance payments, the agency head (or designee) must provide written findings that the action is in the "public interest" or "facilitates the national defense."

Responsibilities

- The Contractor:
- Must submit a written application including a detailed cash flow forecast.
- Must demonstrate that they have exhausted efforts to obtain private financing.
- Responsible for managing the special account and paying required interest.
- Financial Institution:
- Acts as the depository for the special account.
- Reports monthly interest rate changes to the CO and complies with Government withdrawal instructions.
